Welcome to Sworu! These Terms of Service ("Terms") govern your access to and use of the Sworu platform, including our mobile applications, websites, and related services (collectively, the "Platform"). By accessing or using Sworu, you agree to be bound by these Terms.
1. Nature of the Platform
- Sworu is a marketplace that connects customers seeking home or business services with independent pros who offer those services.
- Sworu does not perform services. Sworu does not employ pros. Sworu is not a party to any agreement between customers and pros.
- Sworu does not guarantee the quality, safety, legality, or completion of any job or service arranged through the Platform.
2. Eligibility & Geography
- You must be at least 18 years old to create an account.
- The Sworu Platform is currently offered to users located in the United States. Use from outside the United States is at your own risk and not all features may be available.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
- You agree to provide accurate, current, and complete information and to update your information as needed.
- Sworu reserves the right to suspend or terminate accounts that violate these Terms or engage in prohibited behavior.
4. Customer Responsibilities
- Customers may post jobs describing services they need. Sworu's matching algorithm sends invitations to eligible pros; customers cannot browse, search, or directly select pros outside the offers they receive.
- Customers are responsible for providing accurate job details, communicating expectations clearly, and responding to pros in a timely manner.
- Customers agree to pay pros directly and off-platform (e.g., cash, Venmo, check) for work completed. Sworu does not collect, hold, escrow, or route payments between customers and pros.
- Customers receive a free allocation of tokens used to post jobs (one token per posting). Tokens are returned when a pro admits fault and cancels, and forfeited for customer-initiated cancellations. Tokens are not for sale; additional tokens are earned through completed jobs and successful customer referrals.
5. Pro Responsibilities
- Pros are independent professionals. They are not employees, agents, or representatives of Sworu.
- Pros are responsible for the quality, legality, and safety of the services they provide.
- Pros agree to hold appropriate licenses, insurance, or certifications as required by applicable law. Sworu may verify or display credentials submitted by pros, but verification is informational only and does not certify a pro's competence, identity, or insurance status.
- Pros pay Sworu a platform fee on jobs they win, calculated as a percentage of the offer total. Fees accrue to a fee balance that is automatically charged to the pro's saved payment method per Sworu's published fee schedule. A pro with an unpaid fee balance is blocked from receiving new invitations and from submitting offers on existing invitations until the balance is settled.
6. Fees, Tokens & Refunds
- Posting a job is free. Customers spend one token per posting. Tokens are not sold.
- Pros are charged a platform fee on jobs they win, computed as a percentage of the offer total per the fee schedule shown in the app. Fees are settled automatically against the pro's saved payment method.
- Specific fee percentages, thresholds, and minimums are configured per region and shown in-app at the time of acceptance.
- Sworu may issue refunds of fee-balance charges to pros under our Refund Policy. Customer-to-pro payments are off-platform and are not routed, held, or refundable through Sworu.
7. Prohibited Conduct
Users agree not to engage in:
- Sharing contact information before job confirmation to bypass the platform
- Harassment, threats, discrimination, or abusive behavior toward any user
- Posting false, misleading, or fraudulent information
- Misusing the review or reporting systems
- Creating multiple accounts to circumvent restrictions
- Any illegal activity or violation of applicable laws
8. Reviews & Feedback
- Users may leave reviews and ratings based on genuine experiences.
- Sworu may remove reviews that violate our policies (e.g., fake, abusive, or irrelevant reviews).
- Reviews are not verified for accuracy and represent the opinions of individual users.
- Reviews are limited to jobs that were completed or auto-completed. Reviews on cancelled or never-started jobs are not accepted. Sworu's internal reliability scoring is separate from public reviews and is based on behavioral signals (e.g., cancellations, no-starts) rather than user ratings.
9. Reports & Cancellations
- Users may report safety concerns, misconduct, or violations through the app.
- Sworu may investigate reports and take action including issuing warnings, suspending accounts, or permanently banning users.
- Sworu records cancellation reasons and applies reliability impacts to both customers and pros depending on which party initiated the cancellation and the stated reason. Specific scenarios, including a pro citing customer behavior as the reason, may trigger a fairness-feedback workflow before the impact is finalized.
- Sworu is not responsible for the actions of any user and does not guarantee user safety.
10. Limitation of Liability
- Sworu is not liable for any damages, losses, or injuries arising from the use of the Platform or from interactions between users.
- Sworu is provided "as is" without warranties of any kind.
- In no event shall Sworu's aggregate liability exceed the greater of (a) the amount of platform fees you paid Sworu in the twelve (12) months preceding the claim, or (b) US$100.
11. Indemnification
- You agree to indemnify and hold harmless Sworu, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Platform or your violation of these Terms.
12. Modifications
- Sworu reserves the right to modify these Terms at any time.
- Continued use of the Platform after changes constitutes acceptance of the revised Terms.
13. Governing Law & Disputes
- These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
- Any dispute arising from these Terms or use of the Platform will be resolved in the state or federal courts located in Orange County, California.
